1. AUC MEANS Advances under Collection of Accounts.
2. Bench mark Means amount with respect to Loan (S) pertaining to a borrower as specified against such borrower by the bank in writing.
3. Confidential information MeansAll proprietary and confidential information (or) personal data of the Bank Customers, Clients or Suppliers whether Commercial, Financial, Technical.
4. Loans Means Financial Assistance shall include the loans, Guarantors, Debentures or any other funded Non-Funded Financial Assistance availed.

SARFAESI Means , Securitizasation and Reconstruction of Financial Assets and Enforcement of Security Interest Act 2002.

Enacted by the Central Government, to provide teeth to the Banking Industry, to make Recoveries without the intervention of Courts. Power of the Act:- To enforce the Security Interest without the Intervention of Courts.

Provision:- Provided the Banker/ARC with a legal process to recovery the debt without having to file a case with DRT/CIVIL COURT.

For implementing the said Act, If Oversteps or Misuses or Actions taken by him are not in accordance with the rules and provisions of SARFAESI ACT Borrower is given the opportunity to file an appeal against the Secured Creditor U/Sec 17 of the Act.

Includes:- Rules, Regulations, Directions, Guide lines issued there under time to time.

Courts:-Those have no right to intervene or interfere but if the banks overstep o misuse or do not act in accordance with the rules and provisions of the Act.

SET Notice can be issued after classifying such account add as MPA as per RBI Guide lines : –

Enforcing Agency means :- In the General sense we get whenever we think of any law is that the law enforcing agency means either POLICE OR CID OR CBI OR ANY OTHER PART OF THE EXECUTIVE.
