We would like to introduce ourselves as a firm founded by a Legal Research Scholar, associated with legal professionals and Post Graduates or Graduates. It is expertised in Banking as a Resolution, Recovery, Enforcement and Matrimonial Investigation, Document Verification, Survey of Lands and fixing metes and bonds through out in Telangana, Andhra Pradesh and neighboring states. Headquartered is situated @Tarnaka, Hyderabad and the firm is headed by Dr.K.R.Vijay @Kanthi Vijay Kumar, Qualified as M.A. LL.M ( Constitutional Law From OU) and Ph.D Scholar from University College of Law, Osmania University and associated with legal professionals.

After working for several cooperative banks at a time when those institutions were flourishing, the firm is now offering its services to public sector banks. While the operations are controlled from Hyderabad,

I). S V Enterprises & M/s. K.R.Vijay & Asscoiates is having its branches in various districts of the state. Our offices are currently located in Vijayawada, Warangal, Nalgonda, Mahabubnagar Hyderabad, Medak and Nizamabad.

II). We are currently setting up offices in Karnataka, Maharashtra, Tamil Nadu and Kerala. The office in Vijayawada caters to East Godavari, West Godavari and Visakhapatnam while the Warangal office handles cases in Khammam, Karimnagar and Warangal. There are independent offices in Nalgonda, Nizamabad, Medak and Mahabubnagar. The central office in Hyderabad handles cases in Hyderabad, Rangareddy and parts of Medak.

III). We have a staff strength of 50 including part-timers and IIBF-certified full-time employees. All the employees are graduates and the firm follows a strict policy in paying wages as per the law. The firm does not believe in exploiting the employees. Currently we are offering our services to State Bank of India, State Bank of Hyderabad and Andhra Bank. For the year ended March 2012, S V Enterprises has recovered over Rs 20 crore for all the banks that are utilizing its services. Over 2,000 cases have been directly handled by us during the year. As per the desire of the bankers, a majority of those accounts were regularized while others were concluded either by getting the accounts foreclosed or putting the collateral to sale for recovering the dues. S V Enterprises handles NPA accounts across the spectrum covering movable and immovable properties. For movable properties, the NPA accounts are handled using the hypothecation and hire-purchase agreements. S V Enterprises specializes in enforcing the SARFAESI Act, 2002.

We have demonstrated successfully to the banks the effectiveness of transparent, ethical and strict compliance with the Secularization rules. Being headed and managed by legal professionals, the firm works in close and seamless relation with the bankers right from the stage of preparing and serving notices to the defaulters. By sharing the burden of carrying out the preparation for enforcing the provisions of the SARFAESI Act, S V believes in seeking guidance from the bankers in time-bound execution of the Act and recovery of the NPAs. To sum up, the thrust areas of S V Enterprises are: 1) Recovery and resolution of NPAs.

2) Seizure of movable properties including cars, tractors, buses, lorries, machinery, equipment, etc.

3) Tracing the addresses of borrowers/co-borrowers and guarantors.

4) Investigation of antecedents.

5) Property identification.

6) Serving of notices on the borrowers.

7) Survey of lands (immovable property).

8) Obtaining encumbrance certificates and other certified documents from government agencies.

9) Valuation of NPAs and helping the banks in reconstructing the assets.

10) Filing of OAs and civil suits in DRT and the Courts on behalf of the banks.

11) Verification of loan documents and sale deeds on behalf of bank prior to sanction of loan.

12) Any other banking related outsourcing work including credit appraisal.

We have so far handled the following assignments successfully:

1) Enforcement of SARFAESI Act, 2002 including issuance of Demand Notices, Possession Notices, Prior to Sale Notices (redemption notice), Auction Notices, Paper Publication of Notices through the advertising agencies.

2) Assisting Authorized Officer/CMM/DM appointed Advocate Commissioner/Tahsildar in taking physical possession of secured assets and handing over to Authorized Officer.

3) Conducting Auction proceedings.

4) Filing of Application to CMM/District Magistrate under Section 14 of SARFAESI Act, 2002 to seek the assistance of CMM/DM to take possession of secured assets (mortgaged properties).

5) Filing of Caveat petitions to avoid borrowers filing SA under Section 17 of Securitization Act, 2002 in DRTs.

6) Arranging buyers for sale of mortgaged properties.

7) Recovery of unsecured loans, personal loans, vehicle loans and other NPAs related to Retail segment through negotiation, compromise (OTS).

8) Locating and identifying the properties mortgaged to bank in addition to finding out the properties of the borrowers for attachment by DRT/Civil Court.

9) Locating the present addresses of the borrowers and their whereabouts.

10) Negotiating with borrowers for settlement of loan on behalf of the bank.

11) Serving legal notices for repayment of dues.

12) Arranging for valuation of mortgaged properties/fixed assets.

13) Filing of Original Applications with DRTs in case of Rs.10 lakhs and above accounts and Civil suits in Civil courts in case of less than Rs.10 lakhs accounts.

14) Showing the properties meant for Auction to bidders, resolution managers and valuers.

15) Taking physical possession of property, lock breaking or arrange for lock breaking, arranging videographers, helping Advocate Commissioner and A.O. in all respects of manual labor during physical possession, taking the Advocate Commissioner and A.O. to the location.

16) Serving notices by hand and obtaining the signatures of borrower/borrower’s representatives on those notices.

17) Affixing the notices at residences of borrowers or at mortgaged properties.

18) Distributing pamphlets, displaying banners at places like place of Auction and place of mortgaged property.

19) Identifying the residential addresses of borrowers and getting their telephone numbers to help the bank to negotiate with borrowers.

20) Any other task related to Field Management that is ordinarily undertaken by Field Officers of Banks during their regular course of work.

21) Issuing notices to borrowers and general public under RDDBF Act, 1993.

22) Interacting with Advertising agencies and Valuation agencies to get the notices published in Newspapers and the properties valued at appropriate time.

23) Interacting with A.O. and other Bank Officials to get their endorsement on various documents/notices.

24) Maintaining the borrowers’ records with realtime updates for assisting the advocates/authorities for further action.

25) Updating the bank about the Status of each case as and when inquired by the Authorized Officer.

26) Interacting with Advocates and Advocate Commissioners, coordinating them to complete the process of taking physical possession before the last date of Warrant issued by CMM.

27) Follow up of DRT/Civil Court cases with Advocates.

28) Interacting with borrowers to negotiate for repayment of dues and to bring them on to negotiating table. Following up with the Employers of borrowers to repay the bank’s dues in case of personal loans and filing of cheating cases under Section 418 of IPC wherever necessary through Criminal Lawyers in Sundry loans (less than Rs.5.00 lacs – unsecured loans) to force/effect recoveries from borrowers.
